Downward revision of employment compensation limits

29th January 2010

Following the one-off increase of the maximum ‘week’s pay’ to £380 in October 2009 there is to be no further updating of this in February. However, the usual recalculation has now been done for three other important figures in the Employment Rights (Revision of Limits) Order 2009 SI 2009/3274 and, because of the strange economic times, this has led for the first time to these figures being reduced:

  • the limit on the compensatory award for unfair dismissal goes down from £66,200 to £65,300 (giving a normal maximum of basic plus compensatory award of £76,700);
  • the maximum guarantee payment goes down from £21.50 to £21.20 per day
  • the minimum compensation for an individual excluded or expelled from a trade union in contravention of TULR(C)A s 174 goes down from £7,300 to £7,200.

The changes take effect on 1 February 2010.

There has also been an announcement that SSP (Statutory Sick Pay) is to remain at £79.15 but SMP, SAP and SPP are to rise to £124.88, presumable from April 2010.

Revised Code of Practice

The revised ACAS Code of Practice on Time Off for Trade Union Duties and Activities was brought into effect on 1 January 2010 by SI 2009/3223
