“The Immigration, Asylum and Nationality Act 2006 is only one part of measures that the Government is taking to manage non European Area immigration,” explains Michael Pitt, Partner and head of Employment Law.
Benefits to the economy
“The other major step which is just in force is the new points-based immigration system which is designed to ensure that only those whose skills can be of benefit to the economy are allowed to stay.”
The new Points-based System creates five tiers of points:
Tier 1 - highly skilled migrants such as doctors, engineers, finance experts and IT specialists
Tier 2 - for skilled workers such as nurses, teachers and administrators with a job offer to fill shortages in the labour market
Tier 3 - for low skilled temporary/ seasonal labour
Tier 4 - for students
Tier 5 - for youth mobility and temporary workers/ volunteers.
Michael Pitt adds: “Tier 1 is already in force. Tiers 2 and 5 come in to force in the third quarter of 2008, and Tier 4 in early 2009. Tier 3 has been suspended indefinitely because such jobs are currently being filled by EEA nationals.”
