We find that most employers are simply bewildered by the extent and constant change of employment legislation - keeping up-to-date is time consuming enough for us employment lawyers and it’s our job.
Employment law is essentially a code of working practise which helps businesses to run smoothly. Employers must keep abreast of all changes but it is becoming increasingly difficult as it seems there is a new regulation or change to an existing one each month. For example, last month saw amendments to the Immigration, Asylum and Nationality Act which only came into force in 2006.
Constant change causes confusion, for example with the Statutory Dispute Resolution introduced in October 2004 which caused such uncertainty that industry and businesses put a great deal of pressure on Government to repeal the procedures. The pressure was successful and the Government has since introduced the Employment Bill in December 2007, but there is still uncertainty as to what any new attempt at statutory workplace dispute resolution will entail.
So if Government can’t understand it, businesses can’t make head nor tail and the legal profession struggles, how are we expected to make employment law work in practice? Perhaps more involvement from businesses and solicitors is needed through the decision making process? Or at least road test new legislation.
